Sexual Predator / Sexual Offender Public Notification Procedures
A. The Crime Analyst assigned to the Criminal Investigation Unit is responsible
for the coordination, compilation and distribution of information related to
Registered Sexual Predators and Registered Sexual Offenders living within the
city limits of Ormond Beach. Registered Sexual Predators and Registered Sexual
Offenders are defined as any subject listed by the Florida Department of Law
Enforcement as a Sexual Predator or Sexual Offender. These listings may come
from teletype messages, mailings, the FDLE website accessible via the Internet,
or the FDLE sexual predator hotline. All offenders living within the City must
register with the Volusia County Sheriff Department.
1. Occasionally, Sexual Offenders visit the Ormond Beach Police Department to
obtain information on registering in Volusia County. It shall be the policy of
this Department to provide written instructions to such inquires. The written
instructions will include the physical address and phone number of the facility
where sexual offenders can lawfully
complete registration in Volusia County. It shall be the joint responsibility of
the supervisors of the Records Unit and the Communications Unit to train their
respective employees on this procedure and maintain an adequate supply of
printed handouts.
B. Community Notification Procedure
1. The Crime Analyst shall check the FDLE website on a weekly basis to search
for sexual predators in this community.
2. The Crime Analyst will maintain a bulletin board in the lobby of the Police
Department that will list all Registered Sexual Predators and Registered Sexual
Offenders living within the city limits of Ormond Beach. The board will also
include an abbreviated list of the criteria for inclusion on the list as a
sexual predator / sexual offender. The list is to be
updated on a weekly basis by the Crime Analyst. A free copy of this list will be
made available at the front desk of the police station.
3. Upon notification of the presence of a sexual predator, the Crime Analyst
will forward the information via e-mail to the supervisor in charge of the
Criminal Investigation Unit.
4. It will be the responsibility of the Supervisor of the Criminal Investigation
Unit to coordinate notification to the community and the public of the presence
of the sexual predator.
a. Within 48 hours after receiving notification of the presence of a sexual
predator, the Supervisor of the Criminal Investigation Unit, or his/her designee
shall ensure the notification of each licensed day care center, elementary
school, middle school, and high school within a 1-mile radius of the temporary
or permanent residence of the sexual predator.
b. At a minimum, flyers will be distributed to the specified areas. Sexual
Predators require mandatory notification through one or all of the following
means:
1) Newspaper
advertisements
2) Newspaper
articles
3) Flyer
distribution
4) Homeowners
association newsletters
5) Area schools, day
care centers, and/or any organization whose members are primarily children
(scouts, church
youth groups, etc.)
6) Neighborhood
watch meetings
7) Parks and
recreation facilities
8) Government
buildings
9) Businesses where
children congregate
10) “A Child Is
Missing” Inc. phone notification program
c. Generally, Community Service Officers should be utilized to distribute flyers
and make community notifications, but other members may be used as required. The
members making the community notifications will keep the Criminal Investigations
Unit Supervisor apprised via e-mail as to the progress and/or completion of the
distributions.
5. It will also be the responsibility of the Criminal Investigations Unit
Supervisor to ensure that a log is maintained documenting the notifications.
This log should include:
a. The name and
address of the sexual predator
b. The area affected
c. The names of all
schools notified the method of notification, and the date/time of notification.
d. Community
notification method, date/time, and extent of notification.
6. The Criminal Investigation Unit will evaluate sexual offenders on a
case-by-case basis to determine the extent of community notification. Community
notification is not mandatory for sexual offenders. Community notification may
be accomplished by any, all, or none of the means listed for a sexual predator.
When determining the level of
community notification for sexual offenders, the Supervisor of the Criminal
Investigation Unit should consider the following:
a. The age of the
victim
b. The offender’s
proximity to areas where children congregate
c. The offender’s
crime
7. Information released to the public should include:
a. Name of sexual
predator / sexual offender
b. Description of
sexual predator / sexual offender
c. Photograph of
sexual predator / sexual offender (if available)
d. Address of sexual
predator / sexual offender
e. Circumstances of
the offense
f. Whether the
victim was a minor or an adult at the time of the offense
8. The Supervisor of the Office of Accreditation and Special Projects will
inspect the lobby bulletin board on a quarterly basis to ensure compliance with
this policy and shall document same.
9. The Division Chief in charge of Specialized Services will conduct quarterly
reviews of the notification log maintained by the Criminal Investigation Unit to
ensure compliance with this policy and shall
document same.
