NOVEMBER 16, 1999 7:00 PM Present were: Mayor Dave Hood, Commissioners Jeffrey J. Boyle, Thelma B. Irvin, Frank Gillooly, Carl G. Persis, City Manager Eugene Miller, City Attorney Randy Hayes, and Veronica Patterson, City Clerk. A G E N D A
Item #1 - Call to Order Mayor Hood called the meeting to order at 7:00 PM. Item #2 - Invocation The invocation was given by Reverend Charles Howard, Fellowship Restorational Church. Item #3 - Pledge of Allegiance Mayor Hood led in the Pledge of Allegiance. Item #4(A) - Approval of Minutes Mayor Hood advised the minutes of the November 3, 1999, regular City Commission meeting have been sent to the Commissioners for review and asked if there were any corrections, additions, or omissions. Commissioner Persis moved, seconded by Commissioner Gillooly, to approve the minutes as submitted.
Item #5 - Mayor Hood and Commissioner Gillooly Award Presentation Mr. Eugene Miller, City Manager, advised this is the last official meeting with Mayor Hood and Commissioner Gillooly. On behalf of staff and colleagues, Mr. Miller presented a plaque recognizing Commissioner Gilloolys contributions for the betterment of Ormond Beach during the last two (2) years. Commissioner Persis presented a plaque to Mayor Hood in appreciation of outstanding service as City Commissioner from January 7, 1992, to January 4, 1994, and as Mayor from January 4, 1994, to December 7, 1999. Mayor Hood and Commissioner Gillooly expressed appreciation for the honors. Mr. Kevin Connors, President, Ormond Beach Chamber of Commerce, pointed out the Chamber set a goal to establish a friendly, working relationship with City staff and elected officials, and this goal has been met with the assistance of Commissioner Gillooly and Mayor Hood. Mr. Connors stated both Commissioner Gillooly and Mayor Hood have dedicated their best efforts in building a community to be proud of, and he is proud to call them friend outside of their official capacity as well. On behalf of the Chamber and its 600 members, he presented tokens of the Chambers appreciation for Commissioner Gilloolys and Mayor Hoods support and guidance in the past years. Item #5 - Special Olympics Mayor Hood read a proclamation announcing December 10, 1999, as Special Olympics Florida Day. He stated the concept of Special Olympics began in the early 1960s when Eunice Kennedy Shriver started a day camp for people with mental retardation. Mayor Hood noted in 1968, Mrs. Shriver organized the first International Special Olympics Games at Soldier Field in Chicago, Illinois, and Special Olympics Florida, founded in 1972, is the largest volunteer driven athletic organization in the State involving over 19,000 athletes who have mental retardation, 4,000 coaches, and 25,000 volunteers annually. He stated through successful sports training and competition, Special Olympics athletes develop physically, socially, and psychologically. Mayor Hood advised the City of Ormond Beach is proud to serve as the host community for the roller-skating and bowling competition. Item #6 - Audience Remarks Accolades for Mayor Hood Mr. Dolph Veatch, 43 Alanwood Drive, read a letter from U.S. Representative Tillie Fowler, which expressed appreciation for Mayor Hoods years of service as a City Commissioner and Mayor of Ormond Beach. She pointed to his contributions to Habitat for Humanity, the Citys recreational programs, and Ormond Main Street. Mayor Bill Arthur, Mayor of Holly Hill, congratulated the newly elected Commission members and expressed appreciation to the present City Commission for working so closely with Holly Hill on important issues affecting both cities. On behalf of VCOG, the MPO, the Local Government Study Commission, the Council of Mayors and himself, Mayor Arthur thanked Mayor Hood for his leadership and wished him a bright future. Code Enforcement Complaint Mr. Lawrence Cook, 1529 North Beach Street, distributed a letter to the City Commission members and asked the dates be studied relative to his previous allegations. He expressed disappointment that his questions have not been answered. Accolades for Mayor Hood Ms. Melanie Dolan, 133 Dear Lake Circle, thanked Mayor Hood for his dedication to the children and families of Ormond Beach which is unparalleled. She noted his support of the Volusia County Beach Departments Junior Lifeguard Program, the elementary schools Red Ribbon Anti-drug Campaign, Sports for Life, Dale Buttleman Softball Fields, his efforts in changing City policy that no longer permits tryouts or games on major religious holidays, and his work to assure that girls are treated fairly regarding athletic facilities. Ms. Jane Walters, Executive Director for Habitat for Humanity, stated the exemplary plan Mayor Hood has set in Ormond Beach is unique and one she would like all other mayors to follow. She explained Mayor Hood contacted all the churches in Ormond Beach and gained their commitment to work with businesses, individuals, and organizations throughout the area to build homes for people in need. Ms. Walters advised Mayor-elect Persis has offered a continuance and has given his full support of Mayor Hoods program for the future. She stated David Hood, as a board member for Habitat for Humanity, is needed for his leadership, expertise, and organizational skills. Ms. Walters presented mementos in remembrance of his efforts as Mayor of Ormond Beach from the Halifax Habitat for Humanity. Mr. Doug Thomas stated that under Mayor Hoods guidance, this Commission has been the most youth recreation-oriented commission he has experienced. He expressed his appreciation to the entire Commission for this commitment on behalf of the youth of Ormond Beach, which is its most important resource. Joe and Elwillie Daniels, 56 Fairview, stated Mayor Hood has done a marvelous job for the City and especially for Zone 2 and the South Ormond Neighborhood Center. Item #7 - Consent Agenda Mayor Hood advised that the action proposed to be taken for each item on the Consent Agenda is so stated on the agenda. He asked if any member of the Commission had questions or wished to discuss any one or more of the items separately. Commissioner Persis moved, seconded by Commissioner Gillooly, for approval of the Consent Agenda as presented.
Item #8(A) - First Cycle 1999 Comp Plan Amendments Mr. Henry Liedke, 333 North Yonge Street, stated he and his wife own the southern lot bordering the property owned by the Masonic Lodge. He stated he disagreed with the contention that this change would be advantageous to the property owners and claimed it would lower the property value in the neighborhood. Mr. Liedke stated homes would be harder to sell when the prospective buyer was told there could be a club serving alcohol or anything other than houses built on the lot. He noted the residents have protection now with its zoning, but this protection will be lost if this is approved. Mr. Liedke stated there is no parking problem. He recommended the lodge expand 30 feet to the north where there is 50 feet available which would allow for the required 20 foot easement. Mr. Liedke stated in 1997 a suggestion was made that a conditional land use amendment be granted, but this option was not pursued. He warned this change is only a precursor to when the Planning Department comes back to try to change the land use of the four (4) lots on the north side of Kenilworth Avenue. Mr. Liedke stated if this were to happen, lots will be lost to low and moderate income people, which is what this area was designed for. Mr. Liedke urged the City Commission not to approve this change. Mayor Hood asked Mr. Don O'Donniley, Planning Director, if the setbacks would be violated with an addition to the north; whereby, Mr. O'Donniley stated the addition would invade existing parking and this parking would not be able to be replaced. He clarified this is a land use amendment, not a zoning change, and it would be changed from Commercial, which may permit bars, to Government/Institutional, which will not permit bars; therefore, most of the concerns are being addressed by the proposed amendment. Commissioner Persis moved, seconded by Commissioner Boyle, to close the public hearing on Item #8. The motion carried unanimously. ORDINANCE NO. 99 -50
Commissioner Persis moved, seconded by Commissioner Gillooly, for approval of Ordinance No. 99-50, on second reading, as read by title only. Commissioner Boyle moved, seconded by Commissioner Irvin, to amend to delete the third amendment from Ordinance No. 99-50. Commissioner Boyle explained when a resident has homesteaded for years over a certain set of land use and/or zoning rules and the City wants to change that set of rules, he, personally, needs to have the homeowners in the area agree to the change that will affect them. He stated he has heard from many homeowners opposed to this change, and none is in favor of the change. Commissioner Boyle advised this is a dangerous, precedent setting change for the City to make and violates the spirit of the Land Development Code as well as the homeowners rights. He urged the City Commission to not make this change without the consent of the people who live in the neighborhood.
Item #9 - Renaming Halifax Park RESOLUTION NO. 99 - 200
Commissioner Gillooly moved, seconded by Commissioner Boyle, for approval of Resolution No. 99-200, as read by title only. Ms. Sue Babcock, Ted Porters daughter, thanked the Commission for its consideration and urged the Commission to approve this request to ensure there will be a permanent reminder of the contributions her father made to the City of Ormond Beach.
Item #10 - Audience Comments On Agenda Items Ted Porter Park Mr. Eugene Miller, City Manager, acknowledged Ted Porters wife, June Porter. He stated those who worked with and knew Mr. Porter sincerely appreciate his contribution to this community. Planning Board Appreciation Mr. Harold Bailey, on behalf of the Planning Board, expressed his appreciation to Commissioner Gillooly and Mayor Hood for their years of service. Item #11 - Reports, Suggestions, Requests Accolades for Commissioner Gillooly and Mayor Hood Commissioner Boyle stated Commissioner Gillooly has been a very strong representative for Zone 3 and all the citizens of Ormond Beach. He thanked Commissioner Gillooly for his ideas, decisions, and dedicated service. Commissioner Boyle stated Mayor Hood is deserving of all the many tributes given this evening. He noted Mayor Hood is a powerful mayor with a remarkable record of public service and accomplishment. Commissioner Boyle stated Mayor Hood has presided over a very critical period of time. He advised Mayor Hood has conducted the City Commission meetings with the utmost patience and courtesy, at all times, no matter how trying. Commissioner Boyle reported every public hearing has been fair. He stated Mayor Hood has led by example and made a challenge to others to be better Commissioners, better employees, and better citizens of the community. Commissioner Boyle advised Mayor Hood has kept every promise he has made to the voters and never wavered from the vision of those promises. Commissioner Boyle stated it has been a privilege to serve with Dave Hood and to learn from him. Commissioner Irvin used "GILLOOLY" and "HOOD" as acronyms, using each letter of their names in honoring the accomplishments, service, and leadership to the citizens of Ormond Beach of Commissioner Gillooly and Mayor Hood. Commissioner Gillooly stated he has always cast his votes to reflect the best interest of the people of Ormond Beach. He expressed appreciation to staff, especially the City Manager, City Clerk, City Attorney, Assistant City Attorney, Planning Director, and City Engineer who have answered his questions and cooperated in every way they could. He acknowledged that he and Mayor Hood have had differences of opinion, but he always respected his leadership skills and abilities. He congratulated Mayor-elect Persis, Commissioner-elect Costello and Commissioner-elect High. Commissioner Persis thanked Commissioner Gillooly for his service and for caring enough about this community to run for public office. He expressed appreciation to Mayor Hood for his profession skills, his legal talents, his work with Halifax Habitat for Humanity, his work with South Ormond Recreation, and his efforts with USAL. Mr. Miller stated that while Commissioner Gillooly and Mayor Hood are leaving their official capacity, a friendship has been established that he hopes will continue. Mr. Hayes stated that, on behalf of his staff, it has been a pleasure working with Commissioner Gillooly and Mayor Hood, and he wished them well. Mayor Hood thanked everyone for the very kind remarks. He congratulated Commissioner Gillooly and stated he has respect and admiration for those who serve in this capacity. Mayor Hood stated his philosophy of government is simple: government is here to help the people who dont have what he has, those who need housing, people that, for whatever reason, may not have the economic benefits, but are entitled to the same opportunity and benefits because this is the greatest country in the world. He stated that when the girls did not have athletic facilities, they needed to be treated fairly by having facilities provided, and the children who did not have access to computers in the recreational facilities needed consideration as well. He expressed that these items are important to him, and there are many other things of which this Commission can be very proud. Mayor Hood thanked the entire community for allowing him the privilege and the honor to serve. He thanked his family and the staff. Mayor Hood specifically thanked Mr. Miller for his professionalism. Item #12 - Close the Meeting The meeting was adjourned at 8:00 PM. |
